The OA bill passed last week by the Chamber of Deputies in Argentina, now
has to be discussed in the Senate.

In Argentina, research is mainly State funded, as is the case in general
in Latin America (UNESCO,
2010<http://unesdoc.unesco.org/images/0018/001898/189883e.pdf>
)

Main concepts of the bill approved by the Chamber of Deputies:
- State organizations and institutions belonging to the National Science,
Technology and Innovation System, will have to develop individual or
shared open access institutional repositories, to deposit evaluated
scientific and technological output
- Those organizations and institutions will have to establish policies for
public access to primary research data in institutional or national
digital repositories
- Repositories will have to be interoperable
- And provide conditions for the protection of authors and institutions
rights
- Researchers, technologists, professors, posdoctoral/doctoral/master
students whose research is State funded  will have to self-archive, or
approve deposit -of the final version of their production published or
accepted for publication and/or approved by competent authority- to be
deposited in open access institutional repository not later than 6 months
after publication or approval.
- Primary research data: deposited not later than 5 years
- In the case of scientific and technological production and primary
research data protected by industrial propietary rights and/or previous
agreements with third parties, the authors will provide metadata and
authorize open access to metadata, and deposit the production and/or data
as soon as the industrial property protection or previous agreement
expires. - The Ministry of Science, Technology and Innovation from
Argentina will be the authority of application of this law
- failure to abide by legislation will make those organizations and
institutions not eligible for State funds for research

The bill now will be discussed in the Senate.
